By accessing and using VisionAsk ("the Service"), you accept and agree to be bound by these terms. Please read them carefully before using our educational AI assistant.

1. Acceptance of Terms

By accessing and using VisionAsk ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement.

2. Description of Service

VisionAsk provides an OCR educational assistant application that allows users to scan text using an external camera, extract questions, receive AI-generated answers, and utilize audio playback features. The Service offers different subscription plans with varying features and usage limits.

3. User Accounts

To access most features of VisionAsk, you must register for an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or password, or any other breach of security.

4. Subscriptions and Payments

VisionAsk offers subscription-based access to its services as well as a free tier with limited features. By subscribing to a paid plan, you agree to pay the fees associated with your chosen plan. Fees are billed on a recurring basis (e.g., monthly or annually) as specified at the time of purchase. All payments are processed through a third-party payment processor. We do not store your full credit card information.

5. Usage Limits

Certain subscription plans may have usage limits (e.g., number of requests per month). You agree not to exceed these limits. We reserve the right to monitor usage and take action, including upgrading your plan or suspending access, if limits are consistently exceeded.

6. Academic Integrity and Proper Use

VisionAsk is designed as a learning assistance tool. Users are solely responsible for ensuring their use complies with their institution's academic integrity policies.

6.1. Intended Use

VisionAsk is intended to assist with learning, studying, and understanding educational content. It is designed to help users comprehend concepts, review material, and accelerate competency-based learning.

6.2. User Responsibility

You are solely responsible for ensuring that your use of VisionAsk complies with all applicable academic integrity policies, honor codes, and institutional guidelines. This includes, but is not limited to:

  • Understanding and following your institution's policies on academic assistance tools
  • Properly citing or acknowledging the use of AI assistance when required
  • Not using the service during restricted examinations or assessments
  • Ensuring compliance with any instructor-specific guidelines about AI or external assistance

6.3. Limitation of Liability for Academic Misconduct

VisionAsk Inc. is not responsible for any academic misconduct, violations of academic integrity policies, or disciplinary actions that may result from your use of our Service. You acknowledge and agree that:

  • You are solely responsible for understanding and complying with your institution's academic policies
  • VisionAsk Inc. makes no representations about the appropriateness of using our Service for any specific academic task
  • Any consequences arising from academic policy violations are your sole responsibility
  • VisionAsk Inc. will not be liable for any damages, penalties, or consequences resulting from academic misconduct

6.4. Prohibited Uses

You agree not to use VisionAsk for any purpose that violates academic integrity policies, including but not limited to:

  • Completing graded assessments when external assistance is prohibited
  • Using the service during proctored examinations
  • Violating specific instructor guidelines about AI or external assistance
  • Misrepresenting AI-generated responses as your own original work when prohibited

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of VisionAsk Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. You retain ownership of any content you submit to the Service, but grant us a license to process it for providing our services.

8. User Conduct

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You are responsible for ensuring that any content you process through the Service (e.g., images scanned) does not infringe on the rights of third parties or violate any applicable laws. You also agree to use the Service in compliance with all applicable academic integrity policies.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms, violation of academic integrity policies while using our Service, or any conduct that we determine to be harmful to other users or our Service.

10. Limitation of Liability

Important: This section limits our liability, including for academic integrity issues.

In no event shall VisionAsk Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. This includes, but is not limited to, any damages arising from academic disciplinary actions, violations of academic integrity policies, or any consequences of academic misconduct related to the use of our Service.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. VisionAsk Inc. makes no representations or warranties about the suitability of the Service for academic use, compliance with academic integrity policies, or the accuracy of AI-generated responses. You use the Service at your own risk and discretion.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
